Scope

These terms govern the use of this website and set out the general basis of our services. Any engagement is additionally governed by a written engagement letter agreed with the client, which defines scope, deliverables, timescales and fees. Where these terms and an engagement letter differ, the engagement letter prevails.

What we provide

NuruTrace provides blockchain analysis, financial crime advisory, compliance consulting and professional training. Our work is analytical and advisory in nature.

What we do not provide

We do not provide legal advice. We are not advocates and nothing we produce is legal advice. Advice on your legal or regulatory obligations must come from a qualified advocate. Where our work touches a legal question we will say so and refer it.

We do not take custody of virtual assets. We do not hold, exchange, transfer or safeguard virtual assets or funds on behalf of any client.

We do not guarantee recovery. Tracing establishes where value moved. Whether it can be recovered depends on jurisdiction, on the cooperation of third parties and on legal process, none of which we control. We give no assurance as to outcome, and we do not work on a contingency, commission or percentage-of-recovery basis.

We do not provide financial or investment advice. Nothing we publish or provide is a recommendation to buy, sell or hold any asset.

The basis and limits of our analysis

Blockchain analysis rests partly on public ledger records and partly on inference. Ledger records are matters of fact. Attribution of an address or cluster to a person or entity is an inference drawn from evidence, and it carries uncertainty.

Our reports distinguish between the two and state our level of confidence. Our conclusions are given as at the date of the report and on the basis of the information available to us at that time. Subsequent information, including revised third party attribution data, may alter them.

Client responsibilities

You are responsible for the accuracy and completeness of the information you provide, and for having the lawful authority to provide it to us. Where an instruction involves personal data relating to third parties, you confirm that you have a lawful basis for disclosing it. Do not send us material you are not entitled to share.

Confidentiality

We treat all client information as confidential and do not disclose it except with your authority, or where required by law or by a competent authority. We do not publish client names, case details or outcomes, and we do not use live matters in our marketing. Our confidentiality obligations survive the end of the engagement.

Independence

Where we act as an expert in proceedings, our overriding duty is to the tribunal and not to the instructing party. We will not state a conclusion the analysis does not support, and we will disclose findings that are unhelpful to the party instructing us. Anyone requiring a predetermined conclusion should not instruct us.

Intellectual property

Reports and materials we produce for a client may be used by that client for the purpose for which they were commissioned. The methodologies, tools and know-how underlying them remain ours. Training materials are licensed to the commissioning institution for internal use and may not be resold or delivered commercially to third parties without our written agreement.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud. Subject to that, our liability arising from an engagement is limited to the amount specified in the applicable engagement letter, and we are not liable for indirect or consequential loss, or for loss of profit, revenue or opportunity.

This website

Material published on this site is general information, not advice, and does not create a professional relationship. We take care that it is accurate at the time of publication, but law and practice change. Do not act on anything here without taking advice on your specific circumstances.

Governing law

These terms and any engagement are governed by the laws of Kenya, and the courts of Kenya have jurisdiction, unless an engagement letter provides otherwise.
